Please read these Terms and Conditions (“Terms”) carefully before using any Desert Fox Digital website. By accessing or using our websites, you agree to be bound by these Terms. If you do not agree, do not use our websites.

1. About Our Service

Desert Fox Digital LLC operates lead generation websites that connect consumers seeking home services — including water damage restoration, mold remediation, and pest control — with licensed local service providers. Desert Fox Digital is not itself a home services contractor and does not perform any restoration, remediation, or pest control work.

Our role is limited to:

Receiving your contact and service information through our websites
Matching your request with one or more local service providers based on your location and service need
Transmitting your contact information to those matched providers

2. Eligibility

By using our websites, you represent that:

You are at least 18 years of age
You are the property owner, authorized occupant, or have authority to request services for the property identified in your submission
The information you submit is accurate, current, and complete
You are a resident of the United States

3. Your Information Submission

When you submit a form on a Desert Fox Digital website, you are submitting a request for information and/or connection to home service providers. This submission:

Is not a binding service contract or agreement for work to be performed
Does not guarantee a specific price, service level, response time, or provider availability
May result in contact from one or more service providers by phone, email, or text message (see Section 4 and the Privacy Policy)
May be shared with third-party service providers as described in our Privacy Policy

4. Consent to Communications — Phone, Text & Email

This section governs your consent to receive communications from Desert Fox Digital and/or matched service providers. Read carefully before submitting your information.

4a. Telephone and Text Message Consent (TCPA)

By submitting a form on any Desert Fox Digital website, you expressly agree and consent to receive:

Telephone calls at the number provided, including calls made using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice
Text messages (SMS/MMS) at the mobile number provided, including messages sent via automated systems

These communications may come from Desert Fox Digital and/or the specific service provider(s) matched to your request. The purpose of these communications is to follow up on your home service inquiry, confirm your request details, provide quotes, or schedule service.

4b. Email Consent (CAN-SPAM)

By providing your email address and submitting a form, you consent to receive email communications from Desert Fox Digital and/or matched service providers related to your inquiry. All marketing emails will comply with the CAN-SPAM Act, including:

Identification of the sender in every email
A valid physical mailing address in every email
A clear, functional unsubscribe mechanism in every email
Prompt processing of unsubscribe requests within 10 business days

4c. How to Opt Out

You may withdraw your consent to receive phone calls, text messages, or emails at any time:

Email: Click Unsubscribe in any email, or email privacy@desertfoxdigital.com

5. Accuracy of Information

You agree to provide accurate, truthful, and complete information when submitting requests through our websites. Desert Fox Digital reserves the right to refuse service, cancel leads, or take other appropriate action if we have reason to believe submitted information is fraudulent, inaccurate, or submitted for purposes other than genuine home service needs.

6. No Warranties

DESERT FOX DIGITAL’S WEBSITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
WARRANTIES THAT OUR WEBSITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES
WARRANTIES REGARDING THE QUALITY, RELIABILITY, OR TIMELINESS OF ANY SERVICE PROVIDER CONNECTED THROUGH OUR PLATFORM
WARRANTIES THAT ANY SERVICE PROVIDER IS LICENSED, INSURED, OR QUALIFIED IN YOUR JURISDICTION

You are solely responsible for verifying the credentials, licensing, and insurance of any service provider before entering into a service agreement with them.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DESERT FOX DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

Your use of or inability to use our websites
Any service performed or not performed by a matched service provider
Any unauthorized access to or alteration of your data
Any content or communications received from matched service providers
Any errors or omissions in our website content

In no event shall Desert Fox Digital’s total liability to you for all claims exceed one hundred dollars ($100.00). Some jurisdictions do not allow limitation of liability for certain damages — in such jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Desert Fox Digital and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of our websites; (b) your violation of these Terms; (c) any false or inaccurate information you provided; or (d) your violation of any third-party rights.

9. Intellectual Property

All content on Desert Fox Digital’s websites — including text, graphics, logos, icons, images, and software — is the property of Desert Fox Digital or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written permission.

10. Third-Party Service Providers

Desert Fox Digital does not employ, endorse, or guarantee the work of any service provider to whom we transmit your information. Any service agreement is exclusively between you and the service provider. Desert Fox Digital:

Does not screen, background-check, license-verify, or insure service providers (unless expressly stated)
Is not responsible for any work performed, property damage, personal injury, or financial loss arising from services provided by matched contractors
Does not guarantee any quoted price, timeline, or quality of workmanship

We strongly encourage you to independently verify any service provider’s license, insurance, and reviews before authorizing any work.

11. Prohibited Uses

You agree not to use Desert Fox Digital websites to:

Submit false, fraudulent, or misleading information
Submit requests on behalf of others without their authorization
Harvest contact information for spam or unsolicited marketing
Interfere with or disrupt the operation of our websites
Attempt to gain unauthorized access to our systems
Use our websites for any unlawful purpose or in violation of any applicable law

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our websites shall be resolved exclusively in the state or federal courts located in Pima County, Arizona.

WAIVER OF CLASS ACTION: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

Desert Fox Digital reserves the right to modify these Terms at any time. Updated Terms will be posted on our websites with a revised Effective Date. Continued use of our websites after any modifications constitutes your acceptance of the updated Terms.
